Cancellations & Refunds

Training Cancellation Policy: any cancellations received by email (fearlesstailstraining@gmail.com) or text/phone 343-307-8188 more than 24 hours before the time of a lesson will be honoured without a penalty. Cancellations received less than 24 hours in advance, or failure to attend a lesson will result in forfeiture of the lesson in its entirety. This same penalty applies if Fearless Tails or its agents cannot access the property, are turned away, or if the client is absent or unavailable. Fearless Tails reserves the right to cancel an appointment and to reschedule subject to availability. In the event of a true, unavoidable emergency, all or part of your lesson fee may be applied to future services, at the sole discretion of Fearless Tails.

Pet Care, Board and Train and Play & Learn cancellations are subject to a different cancellation policy, please refer to your specific agreement.

Payments & Refunds

 Payments & Refunds: The Client agrees to make all payments, regardless of your level of participation in the Training Program. If the Client is on a payment plan, and payment is not made in a timely fashion for any reason, Fearless Tails may suspend participation in the Training Program until the account is brought current. In the event of a true and unavoidable situation, Fearless Tails reserves the right to provide refunds at our sole discretion.

 

Training Package Expiration

Training Packages Expiration: Refunds are not provided for services purchased and not used. Training packages are not open ended. Expiration dates are set from the date of purchase. Separation Anxiety 5 or 6 week packages expire after 9 weeks.  

Training Packages with set start and end dates, expire 4 weeks after program end dates. 

All other training packages expire 15 weeks after purchase date. 

Exceptions are at the sole discretion of Fearless Tails.

Memberships apply month to month and expire at the end of each month, unless renewed or recurring.

Client Agreement

I (hereafter referred to as “the Client”), hereby agree to forever release, acquit, discharge, and covenant to hold harmless Tasha Shaw-Verbic and Fearless Tails (hereafter referred to as “the Company”), its trainers, employees, and agents, from any and all actions, causes of action, and claims on account of, or in any way growing out of, directly or indirectly, all known and unknown personal injuries or property damage which I may have or hereafter have, whether attributable to the negligence of Tasha Shaw-Verbic or Fearless Tails, its trainers, employees, or agents, or any other person.

I agree to indemnify and hold harmless Tasha Shaw-Verbic and Fearless Tails, its trainers, employees and agents for all costs and expenses which they may incur due to claims or demands alleging such an injury, including settlement payments, court judgments, and legal defence fees.

This Agreement is binding upon Client, spouse of Client, and children of Client. This agreement supersedes all prior discussions, representations, warranties, and agreements of the parties, and expresses the entire agreement between Client and Fearless Tails regarding the matters described above. Fearless Tails will make every reasonable effort to help Client achieve their training goals but makes no guarantee of the dog’s performance or behaviour as a result of participating in the training. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations, or oral understandings have been made with regard to the Client’s dog or anything else. This Agreement may be amended only by a written instrument signed by both Client and Fearless Tails.

Applicable Law: This contract shall be governed by the laws of the province of Ontario, and any applicable Canadian Federal law.

Bite History: I represent and warrant that I have provided Tasha Shaw-Verbic and Fearless Tails with full and complete, accurate information regarding any bite history and similar incidents or hazardous tendencies of my dog, and that I will update that information if it changes. I understand that I am and will remain responsible for the actions of my dog at all times, and I hereby agree to indemnify, release, and hold harmless Tasha Shaw-Verbic and Fearless Tails of any and all claims, whether made my myself or any third party, of injury, expense, costs, or damages caused by my dog. I understand that I am choosing to pursue training to address my dog’s behavioural issue(s), and in so doing, may be incurring risk to myself and others, and that it is my responsibility to use appropriate safety measures at all times, including muzzling and leashing my dog in the presence of other people and animals.

Confidentiality: During the course of the training program, training plans and strategies will be shared by Fearless Tails. The Client agrees to not share their access to this course with any other persons. Nothing revealed to you by another participant in the Program may be shared, duplicated, disseminated, distributed, or otherwise disclosed in any part for any reason to third parties unless such disclosure (a) is part of the Program, (b) has full permission from the discloser, c) is required by valid legal process (whereby the Client agree to provide prompt written notice of such legal process so that we can take appropriate legal action). In the course of working with the Client, Fearless Tails understands that personal and private information may be shared by the Client. Fearless Tails will not, during the term of their engagement with the Client or any time thereafter, directly or indirectly disclose personal information to any entity or any person who is not a member of the Client or an employee or agent of Fearless Tails.

Client Training practice & education component: Fearless Tails programs always include elements of human education – that is information that helps clients better understand their dog’s behaviour. Examples might include body language, understanding the effect of stress on your dog’s health and welfare – and the impact these have on behaviour. This learning, we feel is crucial to successful behaviour modification and equips the client to more confidently navigate their dog through various situations. Clients can expect to spend approximately 25 – 45 minutes a week reading handouts, watching or listening to short video clips no longer than 5 minutes each. Separation Anxiety Training: the best practice recommendation is to complete departure exercises conducted 5 times a week with one day off. The client will also participate in check-ins once per week during their 6 week program. Behaviour Modification & General Training Practice: Fearless Tails recommends all clients complete practice sessions with their dog will be recommended at minimum 5 – 10 minutes per session, 2 sessions a day, 4 to 5 times a week. Maximum training time is typically 15 – 20 minutes a day, 2 – 3 sessions a day, 4 – 5 times a week. Most clients fall somewhere between the two.

In Home Behaviour Modification Safety Protocols: For the safety of the trainers, clients and dogs, Fearless Tails implements as safety protocol for all in home behaviour modification services and sessions. These will be communicated to the Client in writing prior to the appointment; and may include but is not limited to: dog remains is under leash control; dog is crated; dog is contained in a separate room behind a closed door; client uses a gate at the entry to the home to prevent the dog rushing the door. Prior to entering the home, the trainer will contact the client by phone to confirm all protocols are in place. The trainer may request photos by text as confirmation before entering the home. Failure to comply with all of the required safety measures may result in the session being terminated, at the discretion of Fearless Tails, with no refund for time unused. Signing below indicates the Client’s agreement to comply with this protocol.

Use of Likeness. You agree and accept that Tasha Shaw-Verbic and Fearless Tails is authorized to record, photograph, or otherwise capture the Client’s likeness, voice, images, interviews, and statements made in connection with the Client’s participation in the Training Program. You hereby assign to Tasha Shaw-Verbic and Fearless Tails Academy all rights, title, and interest to have and to use, royalty free, any such likeness or portion of your participation in the Training Program for advertising, marketing, documentary, informational, training, or any other lawful purpose. Images of children under 18 years of age will not be used or shared without written parental consent.

Termination: Fearless Tails is committed to providing all Training Program participants with a positive and productive experience. By signing below, the client agrees that Tasha Shaw-Verbic or Fearless Tails, at its sole discretion, may limit, suspend, or terminate the Client’s right to participate in the Training Program without forgiveness of any previous monthly payments if the Client fails to make required regular payments, wishes to leave, becomes disruptive or difficult to work with, fails to follow Training Program guidelines, uses punishment or aversive methods, or if the Client’s behaviour impairs the ability of instructors or fellow participants to participate in the Training Program. In the rare case of termination, an End of Contract Agreement (ECA) must be signed by both the Client and the Fearless Tails to release the Client from financial obligation and protect the integrity and content of the program.

Liability Waiver: I, the Client, am aware and understand that there is always some unavoidable risk of injury involved when working with animals. I acknowledge and accept the absolute responsibility in following instructions, standards, guidelines and procedures established by Fearless Tails, its trainers, employee or agents. I am voluntarily registering to participate in Fearless Tails’ dog training services with the knowledge of the risks involved and hereby acknowledge and agree to assume any and all risks of injury, death, and/or property damage, whether caused by the negligence of Tasha Shaw-Verbic or Fearless Tails, its trainers, employees, or agents, or any other person.
